Legal guarantees
Two separate guarantees apply to everything sold here. They are set out separately below because they come from different codes, run for different periods and are invoked in different ways.
1. Legal guarantee of conformity
Articles L.217-3 and following, Code de la consommation
The seller is required to deliver an article that conforms to the contract and is liable for any lack of conformity existing at the time of delivery.
An article conforms where, in particular, it:
- corresponds to the description, type, quantity and quality stated on its product page;
- is fit for the purpose for which articles of the same type are ordinarily used;
- has the qualities the seller presented — for this site, that includes the published fibre composition, the recycled percentage, the source type and the certification status;
- is delivered with the accessories and instructions the purchaser may reasonably expect.
Period
You have 2 years from delivery to act. For a new article, any lack of conformity appearing within twenty-four months of delivery is presumed to have existed at delivery, and you do not have to prove it did.
What you may ask for
Repair or replacement, at your choice, subject to cost considerations set out in article L.217-12. If neither can be carried out within one month of your claim, or if it would cause you a major inconvenience, you may obtain a price reduction or the cancellation of the sale and a refund.
Where the article is repaired under this guarantee, the guarantee is extended by six months. Where it is replaced, a new 2-year period starts.
Cost
Nothing. Repair, replacement, return carriage and any labour are at the seller's expense.
2. Guarantee against hidden defects
Articles 1641 and following, Code civil
The seller is liable for hidden defects in the article sold that render it unfit for its intended use, or that so impair that use that the purchaser would not have bought it, or would have paid a lower price, had they known.
Period
You have 2 years from the discovery of the defect to bring an action.
What you may ask for
Either the return of the article against a full refund of the price, or retention of the article against a partial refund, at your choice (article 1644 of the Code civil).
These two are independent
You may rely on either. They exist alongside the 14-day right of withdrawal, which is a different thing again — withdrawal needs no reason and no fault, while these guarantees address an article that is defective or not as described, and last far longer.
What is not a defect
Several characteristics of the materials sold here are stated in advance on the product page and are properties of the material rather than faults:
- pilling on recycled cotton and re-carded wool, which have a shorter staple than virgin fibre;
- shedding of re-carded wool during the first wears;
- tonal variation between production lots of undyed and unbleached cloth;
- dark flecks of plant matter in unbleached linen;
- differences in panel arrangement between individual offcut articles;
- faint streaking across large panels of recycled filament.
Each of these is written on the relevant product page before purchase, in the field headed “how this material differs”. Anything not disclosed there, and anything that goes beyond what was disclosed, is covered by the guarantees above.
How to invoke a guarantee
- Write to support@ecclo.store with your order reference, a description of the problem and photographs where they help.
- We reply within within two working days with a return label or instructions.
